Mr. Shoemaker succeeded in reversing a trial court decision that had granted legal and physical custody of two minor children to their maternal grandmother over the objections of the client mother. The district court decision followed a 6 day evidentiary hearing.  The Court of Appeals reversed the trial court's change of custody, thereby restoring full legal and physical custody of the children to their mother. Following evidentiary hearing, Mr. Shoemaker was successful in enforcing a Colorado child custody determination under Minnesota's Child Custody Jurisdiction and Enforcement Act (MN Stat. ch. 518D) following registration of the Order in Minnesota on behalf of the client father and successfully resisted an application for an Order for Protection sought under chapter 518B wherein the mother alleged domestic abuse and requested the exercise of emergency temporary jurisdiction over custody in Minnesota following her nonconsensual removal of minor children from their Colorado home.In another recent and similar proceeding, Mr. Shoemaker was successful in obtaining a dismissal of an ex parte Temporary Restraining Order on purely legal grounds.

Mr. Shoemaker's civil litigation practice has involved a variety of state and federal claims, involving representation of plaintiffs and defendants at the trial and appellate courts in divorce, real estate, construction law, commercial, business and employment and commissions disputes.

Mr. Shoemaker assisted Attorney Michael K. Hoverson in defending a trial court's decision that found a mortgage was void and unenforceable. The mortgage had been procured by fraudulent means when the husband signed on behalf of the client wife using a fraudulently obtained power of attorney. The Court of Appeals affirmed the trial court's decision in a published opinion.Mr. Shoemaker and co-counsel Michael K. Hoverson jointly represented a custom metal fabricator in complex litigation involving breach of contract and article 2 commercial code issues related to welding, surface preparation and priming of the complex fabricated apparatus. The litigation involved the application of technical and industry welding standards, including the American Welding Society Structural Welding Code for Steel (AWS D1.1). Following 9 days of trial, the Jury awarded the fabricator a verdict of $205,000. The judgment was affirmed on appeal in a published opinion. The case was granted review by the Minnesota Supreme Court. The Minnesota Supreme Court recognized a distinction between discovery depositions and trial depositions and held that the trial court abused its discretion in failing to permit the appellant to conduct 2 trial depositions - see published opinion. The matter was remanded for a new trial.

Mr. Shoemaker has served as counsel to both fiduciaries and beneficiaries in various probate court matters involving estates and trusts.

In a recent litigation matter, Paul Shoemaker and law partner John R. Shoemaker successfully settled and resolved claims brought by a middle aged woman who sustained severe permanent and disabling injuries during an international airline flight. The injuries included serious neck strain, dizziness, TMJ, tinnitus, and closed head injuries/traumatic brain injury. The claims were brought under the provisions of the Montreal Convention of 1999. The matter was resolved and settled in 2018 for an amount not subject to disclosure.
